Surgical Errors

We are frequently asked to assess whether or not an unexpected injury from surgery has been negligently caused. Usually Claimants are alerted to this possibility because they had not been previously informed that a risk of the kind of injury they have suffered was possible. Each case is different and turns on it’s own facts but the kind of cases we have been asked to handle in this field include:-

  1. Severed bile duct in routine gallbladder operations.
  2. The complete through and through cutting of the median nerve during carpal tunnel decompression surgery.
  3. Incision through the bowel in routine vaginal prolapse surgery.
  4. Damage to the bowel in gynaecological keyhole surgery whilst not keeping the instrumentation under direct view.
